SDS PLATFORM TERMS OF USE

Your access to, and use of, the Platform is subject to and conditional upon your acceptance of the following terms and conditions and disclaimer.

  1. Definitions and Interpretation

    1. In these Terms, the following words have the following meanings:
      ACL means the Australian Consumer Law Schedule to the Competition and Consumer Act 2010 (Cth);
      Adama Australia means Adama Australia Pty Ltd of Suite 1, level 4, Building B, 207 Pacific Highway, St. Leonards, NSW;
      Confidential Information means all data, formulae, technical information and any other , reports, information relating to the Platform not in the public domain.
      Data means all content, records, information, results and other data in, on or accessed by or through the Platform;
      Defect includes:

      • a material failure of the Platform; or
      • any part of the Platform that:
        • causes an error message to be displayed by the system that it is running on or being accessed from;
        • results in the Platform doing something that it was not designed to do; or
        • results in the Platform not doing something that it was designed to do;
      Intellectual Property Rights means all intellectual property rights including current and future registered and unregistered rights in respect of copyright, designs, trademarks, trade secrets, know-how, confidential information, patents, invention and discoveries and all other intellectual property;
      Licence means the rights granted by Adama Australia to you in relation to your access to and use of the Platform, in accordance with these Terms and conditions of use;
      parties means Adama Australia and you;
      Platform means:
      • Adama Australia's material safety data sheet platform; and
      • any other program or software provided to you by, or on behalf of, Adama Australia which you use to gain access to the platform;
      SDS means a material safety data sheet provided with products supplied by Adama Australia from time to time whether or not provided to you; and
      Terms means these terms and conditions of use as amended from time to time.

  2. Access

    1. Your Licence to access to, and use of, the Platform is subject to your ongoing compliance with these Terms as amended from time to time. Any amendments to these Terms will be posted to the homepage of the Platform as notification to you.

    2. At any time the Licence may be or terminated or suspended by Adama Australia without cause or notice.

    3. Your right to use and access the Platform is personal to you, and cannot be assigned, novated, sub-licenced or transferred to a third party without the express written consent of Adama Australia.

    4. These Terms are governed by the laws of New South Wales.

  3. Intellectual Property Ownership

    1. You acknowledge that:

      • Adama Australia owns, or has the licence to, all Intellectual Property Rights in the Platform;
      • all Intellectual Property Rights in an SDS and the Data are the sole property of Adama Australia; and
      • you have no proprietary right or interest in the Platform, an SDS or the Data other than that granted to you under these Terms.

    2. You must not provide or otherwise make available the Platform, an SDS or the Data or in any form to any person.

    3. You must not at any time during your use of the Platform, or after termination modify, use, deal with or take advantage of the Intellectual Property Rights in the Platform, an SDS or the Data.

  4. Disclaimer, Warranties and Liability

    1. You acknowledge and warrant that the Data provided on the Platform:

      • is intended as a summary guide and may not be complete;
      • must be used for informational and guidance purposes only;
      • must not be used as a replacement for the SDS; and
      • you will consult the relevant SDS when utilising the Data.

    2. It is your responsibility to:
      • verify the currency and completeness of the information provided on the SDS Platform against the original SDS; and
      • ensure that any actions you take as a result of using the Platform are also consistent with the actions contained in the relevant SDS.
    3. Except as these Terms specifically state, or as contained in any express warranty provided with the Platform, these Terms do not include by implication any other term, condition or warranty in respect of the quality, merchantability, acceptability, fitness for purpose, condition, description, manufacture or performance of the Platform or any contractual remedy for failure.
    4. You acknowledge that the Platform, due to its nature, cannot be guaranteed to be Defect or error free, or that access to the Platform will be continuous or interruption free, and you further accept that the existence of any such errors or interruptions, including any interruption for routine or urgent maintenance of the Program, shall not be construed a breach of these Terms or section 54 of the ACL.
    5. Except as specifically set out in these Terms, Adama Australia makes no representation nor gives any warranty in relation to any incorrect information, performance or functionality which results, partly or wholly, from the Data provided in the Platform.
    6. Adama Australia’s liability for the use of the Platform is as set out in the End User Licence Agreement.
    7. Nothing in these Terms is to be interpreted as excluding, restricting or modifying the application of any State or Federal legislation applicable to the sale of goods or supply of services which cannot be so excluded, restricted or modified.
  5. Confidentiality

    1. You undertake to keep the Confidential Information secret and to protect and preserve the confidential nature and secrecy of the Confidential Information.

Major Health Hazards: Symptoms of high acute exposure to Prometryn may include sedation, muscle incoordination, breathing difficulty, bulging eyes, constricted pupils, diarrhoea, excessive urination, and convulsions. No significant risk factors have been found for this product.

Inhalation
Short term exposure: Long term inhalation of high amounts of any nuisance dust may overload lung clearance mechanism. Available data indicates that this product is not harmful. However product may be mildly irritating, although unlikely to cause anything more than mild transient discomfort.

This is a commercial product whose exact ratio of components may vary slightly. Minor quantities of other non hazardous ingredients are also possible.

The SWA TWA exposure value is the average airborne concentration of a particular substance when calculated over a normal 8 hour working day for a 5 day working week. The STEL (Short Term Exposure Limit) is an exposure value that may be equalled (but should not be exceeded) for no longer than 15 minutes and should not be repeated more than 4 times per day. There should be at least 60 minutes between successive exposures at the STEL. The term "peak "is used when the TWA limit, because of the rapid action of the substance, should never be exceeded, even briefly.

section 4 - First Aid Measures: 

General Information:
You should call The Poisons Information Centre if you feel that you may have been poisoned, burned or irritated by this product. The number is 13 1126 from anywhere in Australia (0800 764 766 in New Zealand) and is available at all times. Have this MSDS with you when you call.
Inhalation: No first aid measures normally required. However, if inhalation has occurred, and irritation has developed, remove to fresh air and observe until recovered. If irritation becomes painful or persists more than about 30 minutes, seek medical advice.
Skin Contact: Gently brush away excess solids. Wash gently and thoroughly with water (use non-abrasive soap if necessary) for 5 minutes or until chemical is removed.
Eye Contact: Quickly and gently brush particles from eyes. No effects expected. If irritation does occur, flush contaminated eye(s) with lukewarm, gently flowing water for 5 minutes or until the product is removed. Obtain medical advice if irritation becomes painful or lasts more than a few minutes. Take special care if exposed person is wearing contact lenses.
Ingestion: If product is swallowed or gets in mouth, do NOT induce vomiting; wash mouth with water and give some water to drink. If symptoms develop, or if in doubt contact a Poisons Information Centre or a doctor.

section 5 - Fire Fighting Measures: 

Fire and Explosion Hazards: There is no risk of an explosion from this product under normal circumstances if it is involved in a fire. Violent steam generation or eruption may occur upon application of direct water stream on hot liquids. This product, if scattered, may form flammable or explosive dust clouds in air.
Fire decomposition products from this product may be toxic if inhaled. Take appropriate protective measures.
Extinguishing Media: Preferred extinguishing media are carbon dioxide, dry chemical, foam, water fog.
Fire Fighting: If a significant quantity of this product is involved in a fire, call the fire brigade. Do not scatter spilled material with high pressure water jets.

section 6 - Accidental Release Measures: 

Accidental release: In the event of a major spill, prevent spillage from entering drains or water courses. As a minimum, wear overalls, goggles and gloves. Suitable materials for protective clothing include rubber, PVC. Eye/face protective equipment should comprise as a minimum, protective goggles. If there is a significant chance that dusts are likely to build up in cleanup area, we recommend that you use a suitable Dust Mask. Use a P1 mask, designed for use against mechanically generated particles eg silica & asbestos. Otherwise, not normally necessary.
Stop leak if safe to do so, and contain spill. Sweep up and shovel or collect recoverable product into labelled containers for recycling or salvage, and dispose of promptly. Consider vacuuming if appropriate. Recycle containers wherever possible after careful cleaning. Refer to product label for specific instructions. After spills, wash area preventing runoff from entering drains. If a significant quantity of material enters drains, advise emergency services.

Full details regarding disposal of used containers, spillage and unused material may be found on the label. If there is any conflict between this MSDS and the label, instructions on the label prevail. Ensure legality of disposal by consulting regulations prior to disposal. Thoroughly launder protective clothing before storage or re-use. Advise laundry of nature of contamination when sending contaminated clothing to laundry.

section 7 - Handling and Storage: 

Handling: Keep exposure to this product to a minimum, and minimise the quantities kept in work areas. Check Section 8 of this MSDS for details of personal protective measures, and make sure that those measures are followed. The measures detailed below under "Storage" should be followed during handling in order to minimise risks to persons using the product in the workplace. Also, avoid contact or contamination of product with incompatible materials listed in Section 10.
Storage: This product is a Scheduled Poison. Observe all relevant regulations regarding sale, transport and storage of this schedule of poison. Keep containers dry and away from water. Protect this product from light. Store in the closed original container in a dry, cool, well-ventilated area out of direct sunlight. Make sure that the product does not come into contact with substances listed under "Incompatibilities" in Section 10. Check packaging - there may be further storage instructions on the label.

The following Australian Standards will provide general advice regarding safety clothing and equipment:

The ADI for Prometryn is set at 0.03mg/kg/day. The corresponding NOEL is set at 3mg/kg/day. ADI means Acceptable Daily Intake and NOEL means No-observable-effect-level. Values taken from Australian ADI List, Sept 2011.
No special equipment is usually needed when occasionally handling small quantities. The following instructions are for bulk handling or where regular exposure in an occupational setting occurs without proper containment systems.

Ventilation: No special ventilation requirements are normally necessary for this product. However make sure that the work environment remains clean and that dusts are minimised.

Eye Protection: Eye protection such as protective glasses or goggles is recommended when this product is being used.

Skin Protection: You should avoid contact even with mild skin irritants. Therefore you should wear suitable impervious elbow-length gloves and facial protection when handling this product. See below for suitable material types.

Protective Material Types: We suggest that protective clothing be made from the following materials: rubber, PVC.

section 10 - Stability and Reactivity: 

Reactivity: This product is unlikely to react or decompose under normal storage conditions. However, if you have any doubts, contact the supplier for advice on shelf life properties.
Conditions to Avoid: Containers should be kept dry. Protect this product from light. Store in the closed original container in a dry, cool, well-ventilated area out of direct sunlight.
Incompatibilities: strong acids, strong bases, strong oxidising agents.
Fire Decomposition: Carbon dioxide, and if combustion is incomplete, carbon monoxide and smoke. Nitrogen and its compounds, and under some circumstances, oxides of nitrogen. Occasionally hydrogen cyanide gas. Water. Carbon monoxide poisoning produces headache, weakness, nausea, dizziness, confusion, dimness of vision, disturbance of judgment, and unconsciousness followed by coma and death.
Polymerisation: This product will not undergo polymerisation reactions.

section 11 - Toxicological Information:

Acute toxicity: Prometryn is slightly to practically non-toxic by ingestion, with reported oral LD50 values of 3750 to 5235 mg/kg in rats, 3750 mg/kg in mice, and greater than 2020 mg/kg in rabbits. Via the dermal route, it is not harmful with reported dermal LD50 values of greater than 2000 mg/kg to greater than 3100 mg/kg in rabbits. Technical prometryn does not cause skin irritation in rabbits or skin sensitization in guinea pigs, and may cause slight eye irritation in rabbits. Some formulations may be mild eye irritants and/or slight skin irritants in rabbits. The 4-hour LC50 for prometryn in rats is 5.2 mg/L.
Chronic toxicity: The results of long-term feeding studies do not indicate obvious, nor severe, toxicity from prometryn exposure. Rats fed dietary doses of 37.5 mg/kg/day and dogs given 4 mg/kg/day over a 2-year period didn't show observable gross or microscopic signs of systemic toxicity. Effects which occurred at higher dose rates in these animals included changes in relative weights of the kidney and liver.
Reproductive effects: In a three-generation study, no reproductive effects were seen in rats fed up to 5 mg/kg/day. From the data, it appears that prometryn is unlikely to cause reproductive effects.
Teratogenic effects: No teratogenic effects were seen in studies of rats fed 250 mg/kg/day, the highest dose tested. Prometryn does not appear to cause birth defects.
Mutagenic effects: Eleven different tests for mutagenicity involving hamsters, bacteria, or mammalian cell cultures have all produced negative results, indicating that prometryn is not a mutagen.
Carcinogenic effects: Prometryn was not carcinogenic in a 2-year rat feeding study at doses of up to 62.5 mg/kg/day. The available data suggest that prometryn is not carcinogenic.
Organ toxicity: Target organs identified through animal studies include the liver, kidneys, and bone marrow.

section 12 - Ecological Information: 

This product is biodegradable. It will not accumulate in the soil or water or cause long term problems.
Effects on birds: Prometryn is practically nontoxic to birds; the acute oral LD50 values in bobwhite quail and mallard ducks are greater than 2150 mg/kg and greater than 4640 mg/kg, respectively.
Effects on aquatic organisms: Prometryn ranges from moderately toxic to highly fish. It is harmful to freshwater invertebrates. The observed concentration of prometryn in bluegill and in rainbow trout is 9 to 10 times the ambient water concentration, indicating a low potential for bioaccumulation.
Effects on other organisms: Prometryn is nontoxic to bees and earthworms, with a reported contact LD50 of greater than 99 μg/bee, and a 48-hour LC50 of 153 mg/kg in earthworms.
Environmental Fate:
Breakdown in soil and groundwater: Prometryn is moderately persistent in the soil, with a field half-life of 1 to 3 months. It will persist longer under dry or cold conditions, which are not conducive to chemical or biological activity.
Breakdown in water: No significant hydrolysis, or breakdown in water, was found when prometryn was tested over a period of 28 days in water ranging from slightly acidic to slightly alkaline and over a variety of test temperatures. These data indicate that prometryn is potentially persistent in the water environment.
Breakdown in vegetation: Prometryn is rapidly absorbed through both the foliage and roots of plants, and is translocated to the growing shoots. Removal or degradation by the plant is rapid in non-susceptible plants, but very slow in susceptible species.
